اسلام آباد (کورٹ رپورٹر) سپریم کورٹ نے احد چیمہ کے خلاف ضمانت منسوخی کی نیب کی درخواست واپس لینے کی بنیاد پر نمٹا دی۔
سپریم کورٹ نے احد چیمہ کو 3 سال جیل میں رکھنے پر نیب پراسیکیوٹر پر برہمی کا اظہار بھی کیا ۔
سپریم کورٹ کی جانب سے کہا گیا ہے کہ 3 سال قید رکھنے کے بعد دوبارہ انویسٹی گیشن پر نیب کو معلوم ہوا کہ ریفرنس بنتا ہی نہیں تھا، نیب قانون کا مذموم مقاصد کے لیے استعمال بند ہونا چاہیے۔
سپریم کورٹ نے کہا کہ نیب کو بنیادی حقوق کی خلاف ورزی کرتے ہوئے بے رحمی سے استعمال کیا گیا، نیب کو آلہ کار کے طور پر مخصوص افراد کے خلاف استعمال کیا گیا۔
چیف جسٹس نے ریمارکس دیے کہ عدالت سوچ رہی ہے کہ احد چیمہ کیس میں جرمانہ کس پر عائد کیا جائے؟ نہیں چاہتے کہ ریاست ہمیں جرمانہ ادا کرے، ریاست نے نیب پر اعتماد کیا تھا، وکلاء کو نیب کی طرف سے ایسے کیسز لینے پر احتجاج کرنا چاہیے۔
چیف جسٹس نے کہا کہ پاکستان ادارے مستحکم ہوں گے تو حکومت چلے گی، پاکستان اداروں میں استحکام لانا ہماری ذمہ داری ہے، نیب اپنی کارکردگی کو قانونی طور پر بہتر کرے۔
