سندھ ہائی کورٹ میں سابق وزیراعظم بینظیر بھٹو کے بھائی مرتضی بھٹو کے قتل کے مقدمے میں ملوث ملزمان کی بریت کیخلاف اپیلوں کی سماعت ہوئی، جسٹس نعمت اللہ پھلپھوٹو نے کیس کی سماعت کی۔ عدالت نے سرکاری وکیل سے استفسار کیا کہ کیس کی پیپر بک بنانے کا کب حکم دیا گیا، جس پر وکیل نے بتایا کہ عدالت نے 2011 میں اپیلوں کی پیپر بک بنانے کا حکم دیا تھا۔
عدالت نے برہمی کا اظہار کرتے ہوئے کہا کہ اتنے عرصے کے بعد بھی حکم پر تاحال عملدرآمد نہیں ہوا، عدالت نے فریقین کو 3 دن میں کیس کی پیپر بک بنانے کا حکم دیتے ہوئے ریمارکس دیئے کہ حکم پر عملدرآمد نہ کیا توسخت حکمنامہ جاری کریں گے۔ سرکاری وکیل نے سندھ ہائیکورٹ کو بتایا کہ کیس میں 18 ملزمان نامزد تھے اور شاہد حیات سمیت کچھ انتقال کر چکے ہیں۔ عدالت نے اپیلوں کی سماعت تین ہفتوں کیلئے ملتوی کر دی۔
واضح رہے کہ میر مرتضی بھٹو کے ملازم نورمحمد گوگا نے ملزمان کی بریت کیخلاف 2010 میں اپیل دائر کی تھی، جس میں مقف پیش گیا کیا کہ 20 ستمبر 1996 کو میر مرتضی بھٹو اور ان کے ساتھیوں کو گھر کے قریب گولیوں کا نشانہ بنایا گیا تھا۔ اپیل میں موقف پیش کیا گیا کہ واقعہ کے بعد سرکار اورمرتضی بھٹو کے ملازم نور محمد کی مدعیت میں دو مقدمات درج کئے گئے تھے لیکن دسمبر 2009 میں ماتحت عدالت نے 20 پولیس افسران کو بری کر دیا تھا۔ واضح رہے کہ اسی عدالت نے مرتضی بھٹو اور ان کے ساتھیوں کو بھی مقدمے سے بری کیا تھا۔
